These Terms & Conditions apply to all buyers and sellers participating in auctions conducted on New York Wine Auctions site, as well as any transactions, purchases, or activities on our affiliated retail site, Leon & Son Wine and Spirits. By registering, bidding, consigning, or requesting shipment, you agree to the terms and conditions outlined below. For these terms, “New York Wine Auctions,” “NYWA,” “us” or “we” refers to the owner of this site. “You,” “your,” “consignor” or “buyer” refers to the viewer of this website. By consigning wine and/or bidding, you acknowledge that you have read, understood, and agreed to the following terms and conditions in full:
1. Consignment Intake
Once a Listing Agreement has been signed and confirmed, consignees are responsible for ensuring and delivering their wines to our Brooklyn, NY warehouse. Consigned wines must be properly packed, shipped, and insured following local and state legal compliance until they are received at New York Wine Auctions. Consignors may: Ship their wines to NYWA using a third-party carrier of their choice (e.g., UPS, FedEx, DHL, or other licensed providers) or deliver their collection in person by appointment only. In-person drop offs must be scheduled at least one business day ahead and within operating hours.
Until your wines are received and formally accepted at our facility, all responsibility for packing, insuring and transit remains with the consignor. Consignors are responsible for ensuring all shipments comply with applicable federal, state, and local shipping laws. All wines must arrive in proper, saleable condition consistent with auction standards. Wines received in an unacceptable condition may be respectfully rejected upon inspection and remain the responsibility of the consignor, who must arrange pickup or re-shipment at their own expense. Once a shipment or drop-off has been received and verified, a confirmation email acknowledging acceptance of your consignment will be sent.
At the consignors' request, we may provide shipping labels through our primary carrier (currently FedEx) and appropriate packing materials. Any associated costs for facilitating shipping to New York Wine Auctions will be deducted from the final settlement following the successful sale of your consignment.
2. Shipping and Delivery
New York Wine Auctions does not ship wine and spirits (“items”) directly to buyers nor does it assume any responsibility for shipment by you or the buyer. All buyer shipments are facilitated through New York Wine Auctions’ affiliated site, Leon & Son Wine and Spirits, who arranges shipment on behalf of successful bidders. By using this service, you, as the buyer, assume sole responsibility for compliance with all local regulations and tax requirements. Leon & Son Wine acts solely as a shipping facilitator and all purchased items shall not pass to the buyer, until payment in full has been received by New York Wine Auctions in cleared funds. Title to, and ownership of all purchased items from successful bids, passes from consignor to buyer in the State of New York, which is why New York State sales tax is charged and collected on your order.
Shipping costs are calculated at checkout to a valid delivery address, and you will be provided with an estimated delivery date. These delivery dates are estimates, and do not account for unforeseen circumstances including shipping delays and lost or damaged packages. No shipping arrangements will be made to any PO addresses.
All packages must be accepted and signed by an adult at least 21 years of age.
Upon New York Wine Auctions receipt of payment in full, purchased items will be released to the buyer and made available for pickup or independent arrangements at NYWA's designated location. In the case of the buyer not personally collecting any purchased items from NYWA, the buyer warrants that all agents authorized to pick-up on their behalf are at least 21 years of age and in appropriate condition to lawfully receive alcohol. If pick-up or independent arrangements are not made following the close of the auction, you may authorize Leon & Son Wine to act on your behalf to engage a common carrier to deliver your order to you and recognize that New York Wine Auctions and Leon & Son Wine & Spirits are not liable for the condition of your package upon delivery. New York Wine Auctions does not assume any responsibility for shipment by the buyer if no arrangements have been made. The buyer is reminded that all sales are final, "as is," and cannot be canceled or refunded for any reason, including any alcohol shipping restrictions. Any shipping or delivery arrangements required after the release of purchased items to the buyer shall be the sole responsibility and expense of the buyer.
You, the buyer, are solely responsible for the shipment of alcohol and responsible for any loss or damage to goods once they have left our premises. By authorizing shipment on New York Wine Auctions through our primary carrier (currently FedEx), you recognize that shipping insurance will be on an opt-in basis and must be communicated before shipment is in carrier possession. If your package is damaged in transit, we are happy to assist you in contacting the shipping carrier for reimbursement; however, the responsibility for this reimbursement lies in that of the carrier. By opt-ing in on shipping insurance, the insurance company is responsible for communicating with you on any potential claims and paying out claims. Please note that any additional fees for delivery to a UPS Store or FedEx locations (including Access Points), or for redirecting packages after shipment, are the responsibility of the buyer.
New York Wine Auctions does not make any representation as to the legal rights of any person or entity to ship, transport, or deliver any purchased alcohol into any state, country, or jurisdiction. The buyer shall be solely and exclusively responsible for the shipping, transportation, and delivery of purchased items to the applicable destination, and compliance with any laws and the payment of all applicable taxes, duties, tariffs, and fees (including without limitation any interest or penalties) associated therewith.
The buyer is solely responsible for collecting items from New York Wine Auctions following the close of the auction and must notify NYWA of any alternative arrangements made. If the buyer elects to ship items through a common carrier, New York Wine Auctions will make a reasonable attempt to assist in arranging and coordinating with buyer's preferred common carrier for collection of the items to be shipped. The buyer will be responsible for all shipping and payment for all shipping/delivery charges.
3. Storage Option
Upon New York Wine Auctions receipt of payment in full in cleared funds, purchased items will be released to the buyer. Within fourteen (14) days from the date title and ownership passes and the item(s) is made available to the buyer, the buyer must (i) arrange to pick up the item(s) purchased from New York Wine Auctions in person; (ii) arrange for the delivery of the wine to a carrier with all necessary permits and licenses for shipment to a destination within or outside the United States; (iii) authorize Leon & Son Wine and Spirits to engage a common shipping carrier to ship your items within United States; (iv) authorize New York Wine Auctions to store your purchased items in our secure temperature-controlled cellar for a monthly storage fee. If the buyer does not select one of the four options above, the buyer will be deemed to have consented to the transfer of the purchased items to NYWA Storage for a monthly fee applied to the card on file, and the buyer will be responsible to pay any and all of storage fees and service charges.
During seasons of extreme weather conditions, NYWA can store purchased items in our cellar for a monthly fee until conditions are appropriate for shipping alcohol or until released from the buyer.
All items purchased on New York Wine Auctions are placed into storage after 14-days of an auction closing for you to continue storing, or schedule to ship or pick up at your convenience. There is a maximum of 14-days of free storage at NYWA provided to any buyer for any item(s) purchased on this site. Returns, Condition Reports, & Claims
All sales conducted through New York Wine Auctions are final. All items are sold “as is,” “where is,” and without warranty or guarantee of any kind, whether express or implied, except as expressly provided herein. Due to the nature of fine and aged wines, each item listed for auction undergoes a rigorous inspection by our team to accurately describe the condition and reduce any risk to buyers. By registering, bidding, and purchasing, you acknowledge and agree that you have had the opportunity to request additional information regarding any item prior to bidding and accept that all purchases are made "as is."
We do not offer refunds or exchanges.
New York Wine Auctions does not accept returns, exchanges, or cancellations of any purchased item(s) for any reason, including but not limited to: Change of mind; Buyer’s remorse; Failure to obtain required shipping permits; State, local, federal, or international alcohol shipping restrictions; Delays in shipment; Natural variation in fill level (ullage), label condition, capsule condition, or packaging; Perceived or actual differences in taste, maturity, provenance, or drinkability.
Wine is a perishable and consumable product. Variations in fill levels, condition, and provenance are common with age and consistent with auction standards. We do not guarantee the drinkability or future performance of any item.
Condition reports, photographs, descriptions, and estimates are provided solely as a courtesy and represent opinions only. They are not warranties or guarantees of any kind. Absence of a condition report does not imply that an item is free from defects or imperfections. Buyers are strongly encouraged to request additional images or clarification prior to bidding.
No claim regarding label condition, capsule condition, cork condition, fill level (ullage), seepage, bottle variation, or other cosmetic or age-related characteristics will be accepted after the close of auction.
Once title has transferred and the item has been released to the buyer or the buyer’s designated carrier or agent, all risk of loss or damage passes to the buyer. Claims for damage or loss in transit must be directed to the applicable carrier and/or insurer.
In the rare event that an item received is materially different from the item purchased, the buyer must notify us in writing within forty-eight (48) hours of receipt and provide photographic documentation. The item must remain unopened and in the same condition as delivered. Failure to provide timely notice constitutes final acceptance of the item. NYWA reserves the sole right to determine whether an item is materially incorrect and, if so, may at its discretion: arrange return of the item; and refund the hammer price and buyer’s premium only, excluding shipping, insurance, taxes, storage fees, or other associated costs.
Our maximum liability, in any circumstance, shall not exceed the hammer price and buyer’s premium paid for the specific item in question. Under no circumstances shall New York Wine Auctions be liable for incidental, consequential, speculative, or investment-related losses.
By bidding, you confirm that you have read, understood, and agreed to these terms in full.
As described in our Privacy Policy, we collect personal information from your interactions with us and our website, including through cookies and similar technologies. We may also share this personal information with third parties, including advertising partners. We do this in order to show you ads on other websites that are more relevant to your interests and for other reasons outlined in our privacy policy.
Sharing of personal information for targeted advertising based on your interaction on different websites may be considered "sales", "sharing", or "targeted advertising" under certain U.S. state privacy laws.
